HERITAGE INSPECTORS
Heritage inspectors appointed under Section 50 of the National Heritage Resources Act (Act 25 of 1999) are entrusted with safeguarding South Africa’s rich cultural and historical legacy. Their powers during inspections are designed to ensure compliance with heritage legislation and to protect heritage resources from damage, neglect, or unauthorised alteration.
POWERS OF HERITAGE INSPECTORS
Where a Heritage Inspector has reasonable grounds to suspect that an offence in terms of the National Heritage Resources Act (Act 25 of 1999) is being, has been, or is about to be committed, a Heritage Inspector is legally empowered to:
- Enter premises at reasonable times to inspect heritage resources.
- Record evidence through photographs, measurements, and notes.
- Monitor permit compliance to ensure work aligns with approved conditions.
- Issue notices for contraventions and refer serious cases for prosecution.
- Order the immediate cessation of works.
- Provide guidance to stakeholders on meeting heritage requirements.
YOUR ROLE IN COMPLIANCE
If you own, manage, or work near a heritage site, it is your responsibility to understand and comply with the National Heritage Resources Act. Always ensure that any work or development is properly permitted.
